For many years many home health agencies have discharged patients who plateaued even when they needed continued skilled care to maintain their level of functioning or prevent deterioration and exacerbation of their condition. Yet the Medicare statute and regulations have never supported the imposition of an “Improvement Standard” in determining whether skilled care is required to prevent or slow deterioration in a patient’s condition. The CMS settlement in recent Jimmo vs Sibelius reaffirmed that when skilled services are required in order to provide care that is reasonable and necessary to prevent or slow further deterioration, coverage cannot be denied based on the absence of potential for improvement or restoration.
